Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Buffalo Mechanical & Refrigeration ("Company," "we," "us," or "our"), concerning your access to and use of our website buffalomr.com and our services.
By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access the website or use our services.
Commercial Customers Only
We serve commercial and industrial customers. We do not provide residential services. You represent that you are requesting services on behalf of a business or organization and that you are authorized to bind that business to an agreement for services.
Age Requirement
You must be at least 18 years of age to use our website, request services, or opt in to receive communications from us. By using our website or services, you represent and warrant that you are at least 18 years old.
Services
Buffalo Mechanical & Refrigeration provides commercial HVAC and commercial refrigeration installation, replacement, preventive maintenance, repair, and emergency service ("Services") to commercial and industrial customers in Texas. All Services are subject to availability and are provided according to the terms of the written service agreement or proposal issued prior to the commencement of work. In the event of a conflict, that signed agreement controls over these Terms.
Quotes and Estimates
Pricing information provided on our website or verbally is for general reference only and does not constitute a binding quote or offer. All quotes and estimates are:
- Subject to site inspection and assessment
- Valid for 30 days from the date of issuance unless otherwise specified
- Subject to change based on actual conditions, equipment access, material costs, refrigerant pricing, and scope of work
- Provided in writing and must be signed to constitute an agreement
- Subject to applicable taxes, fees, and permits
No work will commence without a signed agreement and, where applicable, payment of any required deposit.
Payment Terms
Payment terms are specified in your service agreement. General policies include:
- Deposits may be required before work commences, particularly for equipment orders
- Payment is due upon completion of work unless other arrangements are made in writing
- Late payments may be subject to interest charges as permitted by law
- Non-payment may result in the filing of a mechanic's lien or other legal action
Scheduling and Appointments
We make every effort to arrive within the agreed appointment window. Service times may be affected by weather, emergency calls, traffic, parts availability, or other unforeseen circumstances. We will make reasonable efforts to notify you of significant delays.
If you need to cancel or reschedule, please provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.
SMS/Text Messaging Communications
Eligibility and Age Restriction
You must be 18 or older to consent to receive text messages from Buffalo Mechanical & Refrigeration. By providing a mobile phone number and opting in, you confirm that you are at least 18 and that you are the account holder for, or have the account holder's permission to opt in at, the number provided.
Types of Messages
Transactional / Appointment Messages:
- Appointment confirmations with date, time, and service address
- Reminder messages before a scheduled visit
- Technician arrival and dispatch notifications
- Reschedule or cancellation confirmations
Marketing Communications (Promotional):
- Special offers on services and maintenance agreements
- Seasonal maintenance reminders
- New service announcements and company updates
Message Frequency
Message frequency varies. For appointment messages, you may receive 2–4 messages per scheduled visit. For marketing messages, you may receive occasional promotional messages, typically no more than 4 per month.
Message and Data Rates
Message and data rates may apply based on your mobile carrier's plan. You are responsible for any charges from your carrier related to messages you receive from us.
How to Opt Out
You can opt out of text messages at any time by:
- Replying STOP to any text message from Buffalo Mechanical & Refrigeration

- Unchecking the SMS opt-in boxes on our website contact forms
After you send STOP, we will send one confirmation message, after which you will receive no further messages unless you opt in again. To opt back in, reply START or contact us.

Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. We and our SMS providers are not responsible for messages that are delayed, fail to deliver, or are otherwise affected by your carrier's network. We do not guarantee that messages will be delivered or received in a timely manner. Do not rely on SMS to report an emergency — call us.
Warranties and Guarantees
Workmanship Warranty
We warrant that all work will be performed in a professional and workmanlike manner in accordance with industry standards. Defects in our workmanship will be corrected at no charge if reported within the warranty period specified in your service agreement.
Equipment and Parts
Equipment and parts are covered by the manufacturer's warranty. We are not the manufacturer and do not provide warranties beyond those provided by the manufacturer. We will assist with manufacturer warranty claims as needed.
Warranty Exclusions
Our warranty does not cover:
- Damage caused by improper use, negligence, or abuse
- Failure to follow the manufacturer's maintenance requirements
- Damage from acts of God, natural disasters, severe weather, or power events
- Normal wear and tear
- Work or modifications performed by others
- Failure to provide a proper operating environment for the equipment
- Pre-existing conditions in ductwork, electrical service, drainage, or building envelope
Product Loss and Business Interruption
Refrigeration failures can cause product loss. You are responsible for maintaining appropriate temperature monitoring and alarming, for insuring your inventory, and for taking reasonable steps to protect product once you become aware of a failure — including relocating product where practicable. Except to the extent caused by our gross negligence or willful misconduct, we are not liable for spoiled or lost product, lost revenue, or business interruption. Nothing in this section limits any liability that cannot be limited under applicable law.
Customer Responsibilities
As a customer, you agree to:
- Provide safe and clear access to work areas, including roof access where required
- Inform us of any known hazards, confined spaces, or special site conditions
- Provide accurate information about your equipment, systems, and facility
- Follow the manufacturer's maintenance requirements for installed equipment
- Contact us promptly if you notice a problem with installed equipment
- Maintain any temperature monitoring or alarming appropriate to your refrigerated product
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUFFALO MECHANICAL & REFRIGERATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF PRODUCT OR INVENTORY, BUSINESS INTERRUPTION, LOSS OF DATA, OR LOSS OF GOODWILL, RESULTING FROM:
- Your access to or use of, or inability to access or use, our services
- Any conduct or content of any third party
- Any content obtained from our website
- Unauthorized access, use, or alteration of your transmissions or content
Our total liability for any claim arising out of or related to our services shall not exceed the amount you paid us for the specific service giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Buffalo Mechanical & Refrigeration and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or your violation of these Terms.
Permits and Code Compliance
We will obtain the permits necessary for work performed under our service agreements, and work will be performed in accordance with applicable mechanical codes and regulations. We are not responsible for pre-existing code violations or for conditions that do not meet current codes unless we are specifically contracted to remedy them.
Emergency Services
Emergency service is provided on a best-effort basis and is subject to technician availability, weather, and other factors. Emergency rates apply to after-hours, weekend, and holiday calls. We do not guarantee a specific response time for emergency calls unless a response time is committed in a signed maintenance agreement.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Buffalo Mechanical & Refrigeration or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from our content without our express written permission.
Dispute Resolution
Informal Resolution
If you have a concern or dispute, please contact us first so we can attempt to resolve it informally. We will work in good faith to resolve any problem.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver is effective only if in writing and signed by us.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after a change constitutes acceptance of the new Terms.
Entire Agreement
These Terms, together with any signed service agreement and our Privacy Policy, constitute the entire agreement between you and Buffalo Mechanical & Refrigeration regarding the use of our website and services, and supersede all prior agreements and understandings.
